These Terms and Conditions (the "Agreement") govern the use of services provided by Rubio Family Handyman Services LLC ("Handyman", "we", "us", "our") to the customer ("you", "client") for handyman services. By accepting our services, you agree to these terms and conditions.
1. Services Provided We offer a variety of handyman services, including but not limited to, general repairs, installations, maintenance, and improvements for both residential and commercial properties. A detailed description of the services provided will be outlined in the specific service contract or estimate provided to you.
2. Scheduling and Appointments: We will make every effort to arrive at the agreed-upon time. However, due to unforeseen circumstances, we cannot guarantee exact arrival times but will notify you if there are any significant delays.
3. Service Estimates and Pricing: All estimates are based on the details provided at the time of consultation. Prices quoted for services are subject to change if additional work is required due to unforeseen conditions or changes in the scope of work. You will be informed and must approve any cost changes before proceeding.
4. Payment Terms: Payment is due upon completion of the work unless otherwise specified in the service agreement. We accept payment by Zelle, Cash App, Venmo, credit card, bank transfer, cash, check. A deposit may be required for certain projects, as agreed upon in advance.
5. Lifetime Craftsmanship Warranty: We are committed to the highest standards of workmanship. As part of our customer commitment, we offer a Lifetime Craftsmanship Warranty for the work we perform, subject to the following conditions:
The warranty covers defects in workmanship that are directly related to the tasks completed by our team. It does not cover issues that arise due to faulty materials, normal wear and tear, external damage, neglect, or misuse.The warranty is only applicable to services provided and work completed by Rubio Family Handyman Services (i.e., it does not apply to services or repairs conducted by third parties or unapproved contractors home owner).In the event a warranty issue arises, the customer must notify us within a reasonable timeframe after discovering the defect, and we will schedule a service visit to inspect and resolve the issue at no LABOR cost to the customer. Materials needed to complete the repair are not included.If we determine that the issue is outside the scope of this warranty, any required repairs or replacements will be charged at our standard rate and a minimal trip charge of $45 will be billed and due at the time of the visit, $45 credit will be credited towards the repair. 6. Customer Responsibilities: You agree to provide us with accurate and complete information regarding the work to be performed. You are also responsible for ensuring that the area to be worked on is accessible, clean, and free of any hazardous materials that could impede the work or pose safety risks. If we encounter any such hazards, we may suspend or delay the work until the area is made safe.
7. Limitations of Liability: While we take every precaution to perform the work in a professional and safe manner, we are not responsible for any pre-existing issues or hidden conditions within your property. We will not be held liable for any indirect, incidental, or consequential damages arising from our work, except as expressly stated in the Lifetime Craftsmanship Warranty.
8. Termination of Services: Either party may terminate the agreement at any time before the work begins, with written notice. If the work has already started, the customer is responsible for paying for any work completed up to the termination date, including any materials purchased. In the case of warranty claims, termination of services will not affect the terms of the warranty unless otherwise specified.
9. Indemnification: You agree to indemnify and hold Rubio Family Handyman Services LLC harmless from any claims, damages, or legal actions arising from your negligence, misuse, or failure to adhere to our recommendations regarding the services we provide.
10. Dispute Resolution: Any disputes arising out of or relating to this Agreement shall first be attempted to be resolved through informal negotiation. If a resolution cannot be reached, both parties agree to submit the dispute to binding arbitration in accordance with the law, and the decision of the arbitrator(s) shall be final.
11. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
12. Changes to Terms: We reserve the right to amend or update these Terms and Conditions at any time. Any changes will be posted on our website or provided to you in writing. Your continued use of our services constitutes your acceptance of the updated terms.
